Terms and Conditions

  1. The online store is run by Softmare Ltd, 27 Old Gloucester Street, London, WC1N 3AX.
  2. The online store, hereinafter defens, sells goods posted on the website via the Internet. The orders placed in defens shall be processed by our employees.
  3. All prices in defens shall be gross values ​​expressed in British pounds and shall include VAT. Product prices shall not include costs of transporting the goods to the final recipient. Transport costs shall be covered by the buyer.
  4. The price given for each product shall be binding at the moment of placing the order by the customer. Defens shall reserve the right to change the prices of goods on offer, introduce new goods to the offer of the online store, carry out and cancel promotional campaigns on the store websites or introduce changes to them. The price change shall not apply to the accepted orders.
  5. We shall reserve the right to withdraw from the agreement should the given price of the goods be incorrect as a result of a faulty operation of the ICT system.
  6. Placing an order shall mean completing the order form on the website and sending it to defens. A correctly placed order shall determine the following issues:
    - contact and address details of the: ordering person, payee and payer
    - at least one item of the specified good together with a price
    - a payment method
  7. A number of products offered by the store shall vary and shall be constantly updated.
  8. Payment for the ordered goods shall be made on delivery or in a form of prepayment by a bank transfer or electronic transfer. Electronic transfers shall be operated by Stripe. Payments can be made by a bank transfer, electronic payment or in cash to the courier.
  9. The transfer order (or a postal form) should include the name of the buyer.
  10. The order shall be performed after verification of the recipient or, in case of prepayment, when money is credited to the defens account.
  11. Ordered goods shall be shipped as soon as possible after order verification or the date of crediting payment to the defens account (in case of prepayment).
  12. In the absence of goods in the warehouse, the customer shall be informed about related prolongation of order performance time by phone or email.
  13. The ordered goods shall be delivered via courier or otherwise: at the customer's request.
  14. The moment of sales agreement performance by defens shall mean the day of collecting the consignment from the courier company.
  15. The Buyer may withdraw from the sales agreement (i.e. resign from products purchased from defens and return them without giving a reason) within 30 (thirty) days from the date of taking possession of the products by the Buyer, and in case of a sale agreement including many products delivered separately, in batches or in parts, within 30 (thirty) days from the date of taking possession of the last product, batch or part. In case of withdrawal, the Buyer shall cover the costs. In order to exercise the right of withdrawal from the sales agreement, the Buyer should submit a written statement of withdrawal from the sales agreement by sending it to the correspondence address or sending to the email address: Sale agreement withdrawal form template: 
    I hereby certify that I am withdrawing from the ...................... (subject of sale) sale agreement concluded on ............
  16. All the products sold by defens shall be new, factory packed and covered by manufacturer's warranties. The warranty period shall be 1 year from the date of sale, unless the Manufacturer specifies otherwise. A prerequisite for initiation of the complaint procedure shall be having proof of purchase.
  17. Complaints shall be sent to, together with the name of the faulty products, the quantity and reason for the complaint. A defens consultant shall contact the Buyer to arrange the details. The Buyer shall send the product back to the defens address at their own expense. Should the complaint be accepted, the Buyer shall be entitled to a postage refund. Should the complaint be accepted, defens shall send the Buyer a faulty-free Product at its own expense. Should the exchange not be possible or should the Buyer so wish, they shall receive a refund of the purchase value to the indicated account immediately, but no later than within 14 days from the date of notification. Complaints shall not cover product faults caused as a result of accidental or intentional damage by the Buyer.
  18. Every effort has been made to ensure that the descriptions and technical data of the goods available in the store are true and up-to-date. However, the store shall not be responsible for incorrect specification of parameters and properties of the goods or their sudden change by the manufacturer.
  19. In matters not covered hereby, the provisions of the Polish civil law and relevant acts of Polish law, as well as European Union law, in particular the GDPR (Regulation of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC) shall apply.
  20. The agreement on the sale of goods shall be concluded in accordance with Polish law and in the Polish language.
  21. These Terms and Conditions shall be made available to the customers via a website in a downloadable and printable form.
